These are the official rules (“Rules”) that govern your participation in the Fathom promotion (“Giveaway”).

1. No Purchase Necessary. No purchase or payment of any money is necessary to participate in GIVEAWAY. VOID WHERE PROHIBITED.

2. Sponsor. The sponsor of this promotion is Fathom Video, Inc., 2261 Market Street #4156 San Francisco, CA 94114 (“Sponsor”).

3. Giveaway Period. This Giveaway begins at 9:00 AM United States Mountain Time (“MT”) on July 5, 2021, and ends at 11:59 PM MT on December 31, 2024 (the “Giveaway Period”). The sponsor’s computer is the official time-keeping device. All entries must be submitted and received during the Giveaway Period. The odds of winning depend on the number and timing of entries submitted during the Giveaway Period.

4. Eligibility. The Giveaway is only offered to natural persons who are (i) U.S. legal residents currently residing in the U.S., and (ii) at least the age of 18 years old and the age of majority in their jurisdiction of residence. Participation is limited to individuals who would not violate their employer policies by entering or receiving the prize, and by entering participant represents that he or she is complying with his or her employer’s terms and conditions. Employees of the Sponsor and its parent and affiliate companies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The sponsor reserves the right to cancel, amend or close the Giveaway at any time.

5. How to Enter. To be eligible for a potential prize, the participant must, during the Giveaway Period, earn points through the participant’s Fathom application account (“Fathom App”) by following the instructions below. Each point gives the participant an entry into the monthly drawing and each point the participant earns increases their chance to win the Giveaway at the end of each month. Sponsors may offer alternative ways to earn points during the Giveaway.

   • Share the Fathom App. Invite a user to join the Fathom App. When the user the participant invites sets up the Fathom App, the participant will receive 10 points, and they will receive an additional 1 point every time the user they invited earns a point during the Giveaway Period in the first 7 days after the invited user sets up the Fathom App.

     • Use the Fathom App. To enter by using the Fathom App, a participant must, during the Giveaway Period, log into the participant’s Fathom App and either:

     • Be the Fathom Mayor. Be the first participant at their company to use Fathom on 3 Zoom meetings during the Giveaway Period to earn 25 points. Limit one per participant domain address.

     • Highlight Calls On Fathom. For each week during the Giveaway Period, when a participant Highlights a call on Fathom, they will be rewarded with points that increase as they increase their streak up to 4 weeks: 5 points for Week 1; 10 points for Week 2; 15 points for Week 3; 20 points for Week 4.

     • Submit Fathom App Feedback. Earn 2 points every time the participant submits to the Sponsor feedback about the Fathom App during the Giveaway Period.

     • Customize the Fathom App. Perform the following setup functions within the Fathom App during the Giveaway Period for points: Connect to Salesforce or Salesforce Field for 5 points; link to a Slack channel for 5 points; send a Highlight to Slack for 10 points; enable auto-record for 5 points; enable consent email for 10 points; share a Highlight for 10 points; customize a Highlight for 5 points; create or edit a Highlight post-call for 5 points. Each setup function can be performed once for points.

   • Participants may not earn more than 500 points in any calendar month regardless of method.

• Enter via Form Submission. A participant may also receive an entry point by filling out and submitting their email, full name, phone number, and mailing address using the form at https://share.hsforms.com/10I1zW6KcRIaVwwI_mwj17gbp9jz . Submission must be received by Sponsor within the Giveaway Period. One Entry per submission.

1. Points. Points earned by participating in the Giveaway are not real money, do not have monetary value, and may never be redeemed for “real world” money, or other items of monetary value.

2. Qualification. A participant may enter multiple times, but each individual participant is only eligible for one prize. Multiple participants are not permitted to share the same email or other account needed for participation. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, Zoom accounts, Salesforce accounts, Slack accounts, identities, registrations, logins, or any other methods will void that participant’s entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Each potential winner may be required to show proof of being the authorized account holder. The sponsor will have the right to determine the identity of the participant(s) and the timing of entries at its sole discretion.

3. Prize. There will be one (1) Giveaway winner at the end of each month (the “Winner”). The monthly winner will receive an Amazon Gift Card for one thousand dollars ($1,000).

4. Determining Winner. The winner will be selected in random drawings on the last day of each month until the promotion ends. A participant will have one entry into a drawing for each point that the participant holds at the end of the calendar month. Participants’ points do not carry over month-to-month, and each month a new pool of participants will participate in the drawing made of solely participants from that month. The sponsor will notify the Winner from the Fathom App account via direct/private message or via the email address associated with the Winning Entry with instructions on how to redeem their prize within the time frame designated by Sponsor. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any account. The winner must then respond to Sponsor within five calendar days. Should a winner fail to respond to Sponsor, Sponsor reserves the right to disqualify that winner and select a new one. The winner may be required to sign an affidavit of eligibility, a liability release, and a publicity release. By entering or accepting any prize, Winner allows Sponsor to use Winner’s name, photograph, likeness, voice, prize information, and biographical information for publicity and promotional purposes without further compensation where permitted by law. Except where prohibited, participation constitutes the participant’s consent to the Sponsor’s use of the participant’s name, likeness, voice, opinions, biographical information, hometown, and state for promotional purposes in any media without further payment or consideration.

5. Conditions of Participation. By participating, the participant agrees to abide by these Rules and any decision the Sponsor makes regarding this promotion (including awarding of any prize), which the Sponsor shall make in its sole discretion. Sponsor reserves the right to disqualify and prosecute to the fullest extent permitted by law any participant or winner who, in Sponsor’s reasonable suspicion, tampers the entry or Giveaway process, intentionally submits more than one entry, violates these terms and conditions, or acts in an unsportsmanlike or disruptive manner.

6. Disqualification and Termination. Participants found engaging in any of the following activities may be disqualified and ineligible for any prize: (a) tampering with, disrupting, or attempting to disrupt, or any unauthorized use, misuse, or abuse of any aspect of an entry or Giveaway; (b) violating any applicable law; (c) allowing any unauthorized person to use your email address or other account related to a Giveaway or entry; (d) attempting to perpetrate a fraud on the Giveaway through multiple entries for the same Giveaway, false identification or email addresses, false registration, false impersonation or any other means; (e) failing to provide complete and accurate information required for payment of incentives and/or tax reporting purposes; or (f) for any other breach of these Rules. Termination for any of these reasons may also subject participants to civil and criminal penalties and may result in legal action. The sponsor may invalidate an Entry if the participant does not meet eligibility requirements.

7. Disclaimer, Release, and Limit of Liability. SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE GIVEAWAY. BY PARTICIPATING IN THE GIVEAWAY OR RECEIPT OF ANY PRIZE, EACH PARTICIPANT AGREES TO RELEASE AND HOLD HARMLESS THE SPONSOR AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, PRIZE SUPPLIERS, AND EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING OUT OF PARTICIPATION IN THE GIVEAWAY OR RECEIPT OR USE ****OR MISUSE OF ANY PRIZE. THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR: (A) ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY PARTICIPANTS, PRINTING ERRORS, OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE GIVEAWAY; (B) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR DISCONNECTIONS IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE; (C) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE GIVEAWAY; (D) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE GIVEAWAY; OR (E) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM PARTICIPANT’S PARTICIPATION IN THE GIVEAWAY OR RECEIPT OR USE ****OR MISUSE OF ANY PRIZE. If for any reason a participant’s Giveaway is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the participant’s sole remedy is another entry in the Giveaway, provided that if it is not possible to award another entry due to discontinuance of the Giveaway, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all participants up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, programming, or any other reasons cause more than the stated number of prizes as set forth in these Rules to be available and/or claimed Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims. Sponsor reserves the right to cancel, amend or suspend the Giveaway at any time, with or without prior notice, including if the Giveaway encounters any unexpected problems.

8. Privacy and Use of Giveaway Information. The Sponsor collects personal information from you when you enter this promotion. Sponsor reserves the right to use any information collected in accordance with its privacy policy, which may be found at fathom.video/privacy.

9. GOVERNING LAW AND DISPUTES. THESE RULES AND THE GIVEAWAY ARE GOVERNED BY AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA AND THE UNITED STATES, AND THE FORUM AND VENUE FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES SHALL BE IN SAN FRANCISCO CITY AND COUNTY, CALIFORNIA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR THE SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN UTAH. Any such controversy or claim will be arbitrated on an individual basis, and will not be consolidated in any arbitration with any claim or controversy of any other party. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN CALIFORNIA UNITED STATES. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR RESCINDING THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

10. Winner List. Individuals may request the name of winners by submitting a self-addressed stamped envelope prior to December 31, 2024, to Fathom Video, Inc., 2261 Market Street #4156 San Francisco, CA 94114.

11. No Affiliation. Salesforce, Inc., Zoom, Inc., and Slack, Inc. are not sponsors of or involved in any way in, the Giveaway.
